1. Introduction

These Terms of Service ("Terms") govern your access to and use of MonkeyBot ("the Bot", "the Service"), a Discord bot operated by MonkeyBot ("we", "us", "our"). By using MonkeyBot, you agree to be bound by these Terms. If you do not agree, do not use the Service.

MonkeyBot is available at monkeybot.app.

2. Eligibility

You must be at least 13 years of age (or the minimum age required by the laws in your country) to use MonkeyBot. If you are under the age required to consent to these Terms in your jurisdiction, your parent or legal guardian must agree to these Terms on your behalf.

You must also comply with Discord's Terms of Service and be a registered Discord user in good standing.

3. Description of Service

MonkeyBot is a Discord bot that provides AI-powered chat, live web search, image generation, video generation, and image rating capabilities. The Service integrates with third-party AI providers to process your requests. MonkeyBot is not itself an AI — it acts as an interface between you and third-party AI services.

The Service is provided on an "as available" basis and may be modified, suspended, or discontinued at any time without prior notice.

4. Subscriptions & Billing

4.1 Plans

MonkeyBot offers the following subscription plans:

• Free Trial: A 7-day trial with access to Pro tier features, available once per server.
• Basic ($9.99/month): Unlimited AI chat (Grok only), 15 images/month, 50 live searches/month.
• Pro ($19.99/month): Unlimited AI chat (all 4 models), 40 images/month, 15 videos/month, 150 live searches/month.
• Premium ($39.99/month): Unlimited AI chat (all 4 models + beta features), 60 images/month, 30 videos/month, 300 live searches/month.

Plans are billed per Discord server, not per user. The server administrator whom signed up for the subscription, is responsible for managing the subscription.

4.2 Changes to Pricing

We reserve the right to change our pricing at any time. Existing subscribers will be given at least 30 days' notice before any price increase takes effect on their next billing cycle.

4.3 Refunds

You may request a full refund within 24 hours of being charged by canceling your subscription and contacting us at support@monkeybot.app. After 24 hours, payments are non-refundable. If your subscription is canceled, you retain access until the end of your current billing period.

4.4 Trial Restrictions

Each server is eligible for one free trial. We may deny trials if we detect abuse, including but not limited to creating multiple servers or accounts to obtain additional trials.

5. Accounts & Access

• Access to MonkeyBot requires a Discord account and an active server subscription.
• Certain features (such as image or video generation) require the monkeybot+ Discord role, which is assigned by server administrators at their discretion.
• You are responsible for all activity that occurs through your use of the Bot.
• You may not share, sell, lease, or transfer access to the Bot or any associated accounts.
• You may not use automated tools, scripts, or bots to interact with MonkeyBot.

6. User Responsibilities

By using MonkeyBot, you agree to:

• Comply with all applicable laws and regulations.
• Comply with Discord's Terms of Service and Community Guidelines.
• Comply with our Acceptable Use Policy (see below).
• Not use the Service for any illegal, harmful, or abusive purpose.
• Take full responsibility for all content you submit to the Bot ("Input") and how you use any content the Bot returns to you ("Output").
• Not submit any sensitive personal data, protected health information (HIPAA), or financial data (credit card numbers, bank account numbers, PCI DSS data) to the Bot.
• Not attempt to jailbreak, bypass safety measures, or manipulate the AI models through prompt injection or similar techniques.

7. Third-Party AI Services

MonkeyBot sends your messages to third-party AI service providers for processing. By using the Bot, you acknowledge and consent to your Input being transmitted to these providers:

• xAI (Grok) — chat, live web search, image generation, and video generation
• Anthropic (Claude) — chat
• OpenAI (ChatGPT) — chat and content moderation
• Google (Gemini) — chat

Each provider has its own terms of service and privacy policies. We may add, remove, or change AI providers at any time without prior notice.

8. AI Output Disclaimer

You acknowledge that:

• AI outputs may contain factual errors, "hallucinations," or fabricated information.
• AI outputs do not represent the views or opinions of MonkeyBot or its operators.
• AI outputs should not be relied upon as professional, legal, medical, financial, or any other form of expert advice.
• You are solely responsible for evaluating the accuracy and appropriateness of any Output before using or sharing it.
• You must not represent AI-generated Output as human-generated content.
• Due to the nature of AI, other users may receive the same or similar Output.
• Image and video generation outputs may not accurately depict real people, places, or events.
• AI models may refuse to respond to certain prompts for safety reasons. This is not a service defect or breach of these Terms.

9. Intellectual Property

• You retain ownership of your Input.
• Subject to the terms of the underlying AI providers, you own the Output generated in response to your Input.
• You grant us a limited license to process your Input solely to provide the Service.
• MonkeyBot, its name, logo, and associated branding are owned by us. You may not use our branding without prior written permission.

You agree to indemnify, defend, and hold harmless MonkeyBot's operators, affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising out of or in connection with:

• Your use of the Service.
• Your violation of these Terms or the Acceptable Use Policy.
• Your Input or your use of any Output.
• Any violation of applicable laws or third-party rights by you.

12. Termination & Suspension

• We may suspend or terminate your access at any time, with or without cause, and with or without notice.
• We may terminate access immediately if we reasonably believe you have violated these Terms, the Acceptable Use Policy, or any applicable law.
• Upon termination, your right to use the Service ceases immediately.
• We may cooperate with AI providers or law enforcement if required.
• If your subscription is terminated due to a violation, no refund will be issued.

13. Changes to These Terms

We may update these Terms at any time. Material changes will be communicated through our website or Discord. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of the State of New York.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

16. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet outages, third-party service provider failures, cyberattacks, or other force majeure events.

17. Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms at any time without notice, including in connection with a merger, acquisition, or sale of assets.

18. Entire Agreement & Waiver

These Terms, together with the Privacy Policy and Acceptable Use Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements or understandings. Our failure to enforce any provision of these Terms at any time does not constitute a waiver of that provision or any other provision.

Acceptable Use Policy

1. Introduction

This Acceptable Use Policy ("AUP") applies to all users of MonkeyBot. It defines the types of content and behavior that are prohibited when using the Service. This AUP is designed to be substantially consistent with the acceptable use policies of our AI providers (xAI, Anthropic, OpenAI, and Google).

By using MonkeyBot, you agree to comply with this AUP. Violations may result in warnings, suspension, or permanent ban from the Service.

2. Prohibited Content

You may not use MonkeyBot to generate, request, distribute, or facilitate any of the following:

2.1 Illegal Activity

• Content that promotes, facilitates, or instructs others in illegal activities.
• Drug manufacturing, trafficking, or distribution instructions.
• Content that violates any applicable law.

2.2 Violence & Terrorism

• Content that promotes, glorifies, or incites violence against individuals or groups.
• Content related to terrorism, extremism, or radicalization.
• Instructions for creating weapons, explosives, or other instruments of harm.
• Threats of violence, whether direct or implied.

2.3 Hate Speech & Discrimination

• Content that promotes hatred, discrimination, or violence based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or any other protected characteristic.
• Slurs, derogatory language, or dehumanizing content targeting protected groups.

• Non-consensual sexual content or depictions are strictly prohibited.
• Content that sexualizes real individuals without their consent is strictly prohibited.
• Sexually explicit content is only permitted in age-restricted (NSFW) Discord channels, and only when using AI models that support it.

2.6 Self-Harm

• Content that promotes, encourages, or provides instructions for self-harm, suicide, or eating disorders.
• Content that glorifies or normalizes self-destructive behavior.

2.7 Fraud & Deception

• Scams, phishing, or social engineering schemes.
• Generation of fraudulent documents, fake identities, or misleading content intended to deceive.
• Spam or unsolicited bulk messaging.
• Impersonation of real individuals, organizations, or government entities.

2.8 Privacy Violations

• Sharing or requesting personally identifiable information (PII) of others without consent.
• Doxxing or stalking.
• Attempting to extract personal information about individuals through AI prompts.

2.9 Intellectual Property Violations

• Using the Bot to generate content that infringes on copyrights, trademarks, or other intellectual property rights.
• Reproducing substantial portions of copyrighted works through AI prompts.

2.10 System Abuse

• Attempting to jailbreak, bypass, or circumvent AI safety measures.
• Prompt injection attacks or attempts to manipulate the AI.
• Attempting to extract the system prompt or internal instructions.
• Using the Bot to probe, scan, or test vulnerabilities of any system.
• Circumventing rate limits, usage limits, or other technical restrictions.
• Reverse engineering the Bot or the underlying AI services.

2.11 Sensitive Data

• Submitting protected health information (PHI/HIPAA data).
• Submitting financial account data (credit cards, bank accounts, PCI DSS data).
• Submitting government identification numbers (SSNs, passport numbers, etc.).

Note: MonkeyBot automatically blocks detected sensitive data before it reaches any AI provider.

2.12 Other Prohibited Uses

• Using Output in a way that misrepresents it as human-generated when disclosure is required.
• Using the Bot to develop competing AI models or services.
• Any use that would cause MonkeyBot or its operators to violate the terms of our AI providers or Discord.

3. Enforcement

3.1 Warning (Strike)

For first-time or minor violations, your message will be blocked and you will receive a strike. You will be notified of the specific policy you violated. Strikes expire after 30 days.

3.2 Temporary Suspension

If you accumulate 3 strikes within 30 days, your access will be temporarily suspended for 24 hours.

3.3 Permanent Ban

If you are temporarily suspended and then accumulate 3 more strikes, your access will be permanently revoked. Certain severe violations (including CSAM) result in an immediate permanent ban without prior strikes.

3.4 Ban Appeals

If you believe you were banned in error, you may submit an appeal at monkeybot.app/support. Appeals are reviewed manually and are not guaranteed to be approved.

3.5 Reporting to Authorities

For violations involving illegal activity, child exploitation, or imminent threats of harm, we will report the incident to appropriate law enforcement agencies.

3.6 Provider Cooperation

If an AI provider notifies us of a suspected violation, we will cooperate with the provider to investigate and address the issue.

4. Automated Moderation

We use automated tools (including OpenAI's Moderation API) to detect and flag potential violations. Automated flags may result in immediate blocking of a message before it is sent to an AI provider. If you believe your message was incorrectly flagged, you may contact us to request a review.

5. Reporting Violations

If you become aware of another user violating this AUP, please report it to us at support@monkeybot.app. Include as much detail as possible, including the Discord server, approximate time, and a description of the violation.

6. Changes to This AUP

We may update this AUP at any time to reflect changes in our AI providers' policies, applicable laws, or our own practices. Material changes will be communicated through our website or Discord. Your continued use of the Service after changes are posted constitutes acceptance of the updated AUP.
